2. COLLECTION AND STORAGE OF PERSONAL DATA AND THE NATURE AND PURPOSE OF ITS USE

When you visit our website https://www.landgraf-holding.com, the browser used on your terminal device automatically sends information to the server of our website. 2.1.2 Analysis/tracking tool

2.1.2.1 Matomo

Our website uses the open source software Matomo (formerly Piwik). Matomo is a web analysis service for statistical evaluation of the use of the website. The analysis is carried out by transferring the usage information (including your shortened IP address) generated by a Matomo cookie (see Section 2.1.1 for the term “cookie”) to our server and summarising and storing it in pseudonymous usage profiles for usage analysis purposes. This information is used to evaluate the use of the website and to enable us to tailor our website to meet your needs. The information will not be passed on to third parties. Under no circumstances will the IP address be associated with other data relating to the user. The IP addresses are anonymised so that an allocation is not possible (IP masking). 2.1.2.3 Google Adwords Conversion Tracking

We also use Google Conversion Tracking to record the use of our website statistically and to evaluate it for the purpose of optimising our website for you. Google Adwords places a cookie (see section 2.1.1) on your computer if you have reached our website via a Google advertisement. These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of the AdWords customer’s website and the cookie has not expired, Google and the customer will be able to tell that the user clicked on the ad and was directed to that page. Each Adwords customer receives a different cookie. Cookies can therefore not be traced via the websites of Adwords customers. The information collected using the conversion cookie is used to generate conversion statistics for Adwords customers who have opted for conversion tracking. Adwords customers will know the total number of users who clicked on their ad and were directed to a page with a conversion tracking tag. – reCAPTCHA

To protect your requests via the Internet form, we use the service reCAPTCHA of the company Google Inc. (Google). The query serves to differentiate whether the input is made by a human being or whether it is misused by automated, mechanical processing. The query includes the transmission of the IP address and any other data required by Google for the service reCAPTCHA to Google. For this purpose your input will be transmitted to Google and used there. However, your IP address will be shortened by Google in advance within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of this service. The IP address transmitted by your browser as part of reCaptcha is not merged with other data from Google. These data are subject to the differing data protection regulations of Google. Our website uses functions of Google +1. Provider is Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. Collection and disclosure of information: You can use the Google +1 button (identified by the “+1” sign) to publish information worldwide. The Google +1 button gives you and other users personalized content from Google and our partners. 2.1.3.3 Xing

Our website uses functions of the XING network. The provider is XING AG, Dammtorstraße 29-32, 20354 Hamburg, Germany. Each time you access one of our pages that contains Xing functions, a connection is established to Xing servers. To the best of our knowledge, personal data is not stored. In particular, no IP addresses are stored or the usage behaviour evaluated. 2.1.3.4 Youtube

Our website uses plugins from the YouTube site operated by Google. The site is operated by YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA. When you visit one of our pages equipped with a YouTube plug-in, a connection is established to YouTube’s servers. The Youtube server will be informed which of our pages you have visited. If you are logged in to your YouTube account, you can allow YouTube to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account. 2.1.3.5. Facebook

Social media plugins from Facebook are used on our website to make their use more personal. For this we use the “LIKE” or “SHARE” button. This is an offer from Facebook. If you call up a page on our website that contains such a plugin, your browser establishes a direct connection with the Facebook servers. The content of the plugin is transmitted directly from Facebook to your browser, which integrates it into the website. If you have any questions, we offer you the opportunity to contact us via the e-mail address provided on the website. We require your first and last name and a valid e-mail address so that we know who sent the enquiry and can answer it. It is not necessary to provide further data. Data processing for the purpose of establishing contact with us or by us takes place in accordance with Art. 6 Para. 1 S. 1 lit. a DSGVO on the basis of your voluntary consent. 3. DATA TRANSFER

Your personal data will not be transferred to third parties for purposes other than those listed below. We will only pass on your personal data to third parties if:

– you have given your express consent in accordance with Art. 6 Para. 1 S. 1 lit. a DSGVO,

– this is legally permissible and required according to Art. 6 Para. 1 S. 1 lit. b DSGVO for the processing of contractual relationships with you (e.g. postal/parcel services, processing of payments), and

– in the event that there is a legal obligation to pass on data pursuant to Art. 6 (1) sentence 1 lit. c DSGVO, or

– the passing on according to Art. 6 para. 1 sentence 1 lit. f DSGVO is necessary for the assertion, exercise or defence of legal claims, also against contractual partners, or the continuous analysis and improvement of our offer as well as the maintenance of the attractiveness of our offer (e.g. maintenance of customer lists, analysis of databases, advertising measures, offer of modern technical solutions) and there is no reason to assume that you have an overriding legitimate interest in not passing on your data.

Insofar as we use the services of third parties for our processing as contract processors within the meaning of the DSGVO, we maintain the necessary contractual relationships with them within the meaning of Art. 28 DSGVO. Data will only be transferred to third parties in countries outside the EU (third countries) if and to the extent that you have consented to this or if we have a legitimate overriding interest in this. Should such data transfer occur, we will contractually ensure that the processors there comply with a data protection level corresponding to that of the European Union.

4. RIGHTS AFFECTED

You have the right

– to request information about your personal data processed by us in accordance with Art. 15 DSGVO. In particular, you may request information on the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right of rectification, deletion, restriction of processing or objection, the existence of a right of complaint, the origin of your data, unless it has been collected from us, as well as the existence of automated decision-making including profiling and, where applicable, meaningful information on its details;

– to demand the immediate correction of incorrect or incomplete personal data stored by us in accordance with Art. 16 DSGVO;

– to demand the deletion of your personal data stored by us in accordance with Art. 17 DSGVO, unless processing is necessary for the exercise of the right to freedom of expression and information, for the fulfilment of a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims;

– to demand the restriction of the processing of your personal data in accordance with Art. 18 DSGVO if the correctness of the data is disputed by you, the processing is unlawful but you refuse its deletion and we no longer need the data but you need it to assert, exercise or defend legal claims or you have lodged an objection to the processing in accordance with Art. 21 DSGVO;

– to receive, in accordance with Art. 20 DSGVO, your personal data which you have provided to us in a structured, common and machine-readable format or to request the transfer to another responsible person;

– to revoke your consent once given to us at any time in accordance with Art. 7 para. 3 DSGVO. The consequence of this is that we may no longer continue the data processing based on this consent for the future, and

– pursuant to Art. 77 DSGVO to complain to a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our office.

5. RIGHT OF OBJECTION

If your personal data are processed on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 lit. f DSGVO, you have the right, pursuant to Art. 21 DSGVO, to object to the processing of your personal data if there are reasons for doing so which arise from your particular situation or if the objection is directed against direct advertising. In the latter case, you have a general right of objection, which is implemented by us without stating a particular situation. 6. DATA SECURITY

We use the most common SSL (Secure Socket Layer) method in connection with the highest level of encryption supported by your browser. As a rule, this is a 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is transmitted in encrypted form by the closed representation of the key or lock symbol in the lower status bar of your browser. We also use suitable technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorised access by third parties (e.g. firewall system). Our security measures are continuously improved in line with technological developments.
