2. COLLECTION AND STORAGE OF PERSONAL DATA AND THE NATURE AND PURPOSE OF ITS USE

2.1 Visiting the Website

When you visit our website https://www.landgraf-holding.com, the browser used on your terminal device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until it is automatically deleted:

– IP address of the requesting computer,

– Date and time of access,

– Name and URL of the retrieved file,

– Website from which access is made (referrer URL),

– browser used and, if applicable, the operating system of your computer as well as the name of your access provider.

– The data mentioned will be processed by us for the following purposes:

– Guarantee of a smooth connection setup of the website,

– Ensuring a comfortable use of our website,

– Evaluation of system safety and stability as well as

– for further administrative purposes.

The legal basis for data processing is Art. 6 Para. 1 S. 1 lit. f DSGVO. Our legitimate interest follows from the purposes listed above for the collection of data. Under no circumstances do we use the collected data for the purpose of drawing conclusions about your person.

In addition, we use cookies, analysis services and plug-ins when you visit our website.

2.1.1 Cookies

We use cookies on our site. These are small files that are automatically created by your browser and stored on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do not cause any damage to your terminal device and do not contain viruses, Trojans or other malware.

Information is stored in the cookie, which results in each case in connection with the specifically used terminal device. This does not mean, however, that we will immediately become aware of your identity. The use of cookies serves on the one hand to make the use of our offer more pleasant for you. For example, we use so-called session cookies to recognise that you have already visited individual pages on our website. These are automatically deleted after leaving our site. In addition, we also use temporary cookies to optimise user-friendliness, which are stored on your terminal for a specific period of time. If you visit our site again to make use of our services, it is automatically recognized that you have already been with us and which inputs and settings you have made so that you do not have to enter them again. On the other hand, we use cookies in order to statistically record the use of our website and to evaluate it for the purpose of optimising our offer for you (see Section 2.1.2). These cookies enable us to automatically recognise that you have already visited our site when you visit it again. These cookies are automatically deleted after a defined period of time. The data processed by cookies are required for the purposes mentioned to safeguard our legitimate interests and those of third parties for the technically error-free and optimised provision of its services in accordance with Art. 6 Para. 1 S. 1 lit. f DSGVO. Most browsers automatically accept cookies. However, you can configure your browser so that no cookies are stored on your computer or a message always appears before a new cookie is created. The complete deactivation of cookies may, however, result in you not being able to use all the functions of our website.

2.1.2 Analysis/tracking tool

2.1.2.1 Matomo

Our website uses the open source software Matomo (formerly Piwik). Matomo is a web analysis service for statistical evaluation of the use of the website. The analysis is carried out by transferring the usage information (including your shortened IP address) generated by a Matomo cookie (see Section 2.1.1 for the term “cookie”) to our server and summarising and storing it in pseudonymous usage profiles for usage analysis purposes. This information is used to evaluate the use of the website and to enable us to tailor our website to meet your needs. The information will not be passed on to third parties. Under no circumstances will the IP address be associated with other data relating to the user. The IP addresses are anonymised so that an allocation is not possible (IP masking). Your visit to this website is currently recorded by Matomo Web Analysis. Click https://matamo.org/docs/privacy/) so that your visit is no longer recorded. This measure is implemented on the basis of Art. 6 Para. 1 S. 1 lit. f DSGVO. With the tracking measures used, we want to ensure that our website is designed to meet your needs and is continuously optimised. On the other hand, we use the tracking measures in order to statistically record the use of our website and to evaluate it for you for the purpose of optimising our offer. These interests are to be regarded as justified within the meaning of the aforementioned provision.

2.1.2.2 Google Analytics

We use Google Analytics, a web analysis service provided by Google Inc., for the purpose of tailoring our pages to meet your needs and continuously optimising them. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter referred to as “Google”). In this context, pseudonymised user profiles are created and cookies (see section 2.1.1) are used. The information generated by the cookie about your use of this website such as

– Browser type/version,

– operating system used,

– Referrer URL (the previously visited page),

– Host name of the accessing computer (IP address),

– Time of the server request,

are transferred to a Google server in the USA and stored there. This information is used to evaluate the use of the website, to compile reports on website activity and to provide other services relating to website activity and internet usage for market research purposes and to tailor these internet pages to meet requirements. This information may also be transferred to third parties if this is required by law or if third parties process this data on behalf of third parties. Under no circumstances will your IP address be merged with other Google data. The IP addresses are anonymised so that an allocation is not possible (IP masking). You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. You can also prevent the collection of data generated by the cookie and relating to your use of the website (including your IP address) and the processing of this data by Google by downloading and installing a browser add-on (https://tools.google.com/dlpage/gaoptout?hl=en). Further information on data protection in connection with Google Analytics can be found in the Google Analytics help (https://support.google.com/analytics/answer/6004245?hl=en).

2.1.2.3 Google Adwords Conversion Tracking

We also use Google Conversion Tracking to record the use of our website statistically and to evaluate it for the purpose of optimising our website for you. Google Adwords places a cookie (see section 2.1.1) on your computer if you have reached our website via a Google advertisement. These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of the AdWords customer’s website and the cookie has not expired, Google and the customer will be able to tell that the user clicked on the ad and was directed to that page. Each Adwords customer receives a different cookie. Cookies can therefore not be traced via the websites of Adwords customers. The information collected using the conversion cookie is used to generate conversion statistics for Adwords customers who have opted for conversion tracking. Adwords customers will know the total number of users who clicked on their ad and were directed to a page with a conversion tracking tag. However, you will not receive any information that personally identifies users.

If you do not wish to participate in the tracking process, you can also refuse to set a cookie as required, for example by setting your browser to disable the automatic setting of cookies. You can also deactivate cookies for conversion tracking by setting your browser to block cookies from the domain “www.googleadservices.com“. Google’s Privacy Policy for Conversion Tracking can be found here (https://services.google.com/sitestats/de.html).

– reCAPTCHA

To protect your requests via the Internet form, we use the service reCAPTCHA of the company Google Inc. (Google). The query serves to differentiate whether the input is made by a human being or whether it is misused by automated, mechanical processing. The query includes the transmission of the IP address and any other data required by Google for the service reCAPTCHA to Google. For this purpose your input will be transmitted to Google and used there. However, your IP address will be shortened by Google in advance within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of this service. The IP address transmitted by your browser as part of reCaptcha is not merged with other data from Google. These data are subject to the differing data protection regulations of Google. For more information about Google’s privacy policy, please visit: https://www.google.com/intl/de/policies/privacy/.

2.1.3 Plug-ins

We use plug-ins on our website.

2.1.3.1 Google +1

Our website uses functions of Google +1. Provider is Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. Collection and disclosure of information: You can use the Google +1 button (identified by the “+1” sign) to publish information worldwide. Your +1 may be displayed as a clue along with your profile name and photo in Google services, such as search results or your Google profile, or other places on websites and ads on the Internet. Google records information about your +1 activity to improve Google services for you and others. To use the Google +1 button, you need a globally visible, public Google profile that includes at least the name you choose for the profile. This name will be used in all Google services. In some cases, this name may also replace another name you used when sharing content through your Google Account. The identity of your Google profile may be displayed to users who know your email address or have other identifying information about you. Use of Information Collected: In addition to the uses described above, the information you provide will be used in accordance with applicable Google privacy policies. Google may publish or share aggregated statistics about users’ +1 activity with users and partners, such as publishers, advertisers, or affiliates. Even if you do not have a Google public profile, there is still a chance that Google will know and remember your IP address when you activate the button on our website. When you visit one of our pages equipped with a YouTube plug-in, a connection is established to YouTube’s servers. The Youtube server will be informed which of our pages you have visited. If you are logged in to your YouTube account, you can allow YouTube to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account. If you interact with the plugins, for example by pressing the “LIKE” or “SHARE” button, the corresponding information is also transmitted directly to a Facebook server and stored there. The information is also published on Facebook and displayed to your Facebook friends. Facebook may use this information for the purposes of advertising, market research and tailoring Facebook Pages to your needs. To this end, Facebook creates usage, interest and relationship profiles, e.g. to evaluate your use of our website with regard to the advertisements displayed to you on Facebook, to inform other Facebook users about your activities on our website and to provide other services associated with the use of Facebook. If you do not want Facebook to associate the information collected through our website with your Facebook account, you must log out of Facebook before visiting our website. The purpose and scope of the data collection and the further processing and use of the data by Facebook as well as your related rights and setting options for the protection of your privacy can be found in Facebook’s data protection information (https://www.facebook.com/about/privacy/).

Twitter receives the information that you have visited our site with your IP address. If you click the Twitter “tweet” button while logged into your Twitter account, you can link the content of our pages to your Twitter profile. This allows Twitter to assign the visit to our pages to your user account. We would like to point out that, as the provider of the pages, we do not have any knowledge of the content of the data transmitted or its use by Twitter. If you do not want Twitter to be able to assign visits to our pages, please log out of your Twitter user account. Further information on this can be found in Twitter’s privacy policy (https://twitter.com/privacy).

2.1.3.7 Instagram

Our website also uses social plugins (“Plugins”) from Instagram, operated by Instagram LLC, 1601 Willow Road, Menlo Park, CA 94025, USA (“Instagram”). The plugins are marked with an Instagram logo, for example in the form of an “Instagram camera”. When you visit a page on our website that contains such a plugin, your browser connects directly to Instagram’s servers. Instagram sends the content of the plugin directly to your browser and integrates it into the page. This integration tells Instagram that your browser has accessed the appropriate page on our site, even if you do not have an Instagram profile or are not logged into Instagram. This information (including your IP address) is transferred directly from your browser to an Instagram server in the USA and stored there. If you are logged in to Instagram, Instagram can directly associate your visit to our website with your Instagram account.
